# GlobalMonero Terms of Service
GlobalMonero ("Global Monero," "GM," "globalmonero.co" or "we" or "our") is a peer discovery and escrow service. These Terms of Service outline our role as a provider of this service, and your role as a Client on our platform.
## Agreement
By accessing and using GlobalMonero, you accept the terms and conditions outlined in the following document. You also agree to accept any potential changes made to the Terms of Service by continuing to use GlobalMonero. **If you do not accept the terms and conditions outlined in this document, do not access or use GlobalMonero.**
## Liability Disclaimer
GlobalMonero functions as a peer-to-peer ("P2P") discovery service between prospective traders of Monero ("XMR"). GlobalMonero and the features it provides are purely to facilitate discovery and safe interaction between peers; it is not liable for trades faciliated between users, on or off of the platform.
Keep in mind that disputes of any kind are handled on a case-by-case basis, and GlobalMonero assumes no liability for activity or functionality on or off its platform.
## Usage
This section outlines agreements to use of our platform including requirements for usage and disallowed activity.
### Account Registration
To register an account on GlobalMonero, you acknowledge the following requirements are met:
- The client(s) is/are 18 years of age or older.
- The email address, if provided, is owned exclusively by the client(s), and can be used for communication with the client.
- The username on the account is not in violation of any intellectual property and does not impersonate any client, potential client, GlobalMonero, or any other living person.
- The client(s) operating the account do not already operate another GlobalMonero account.
- The client(s) operating the account fulfil any legal obligations related to activities on GlobalMonero set by their local jurisdiction.
By registering for an account, you certify that the information provided is owned exclusively by the client operating the account.
#### Know Your Customer ("KYC")
As a platform, GlobalMonero is strictly no-KYC. GlobalMonero will never ask you for personally identifiable information such as your legal name, phone number, or government identification. We accept all valid email addresses, and adding an email address is optional (unless you intend to post a trade offer). Other users on the platform may ask you for KYC, depending on their own trade offer's terms of agreement.
#### Account Limitation and Termination
In some cases, your GlobalMonero account could be limited or terminated. This could be a result of an account closure requested by the account, a violation of our Terms of Service, or other potential situations in which we are unable to safely operate your account. If your account is terminated by GlobalMonero without request, you agree to not create another account.
If your account is **limited**, you will be able to log in and access GlobalMonero, but your ability to use most features on the platform will be unavailable. Account limitation could be temporary or permanent depending on the situation. You will be able to view most of the platform, but the only actions you can take are account closure requests, email changes, and withdrawals. **Deposits may not be honored while your account is limited** -- if you mistakenly make a deposit, and the deposit is not honored please contact service@globalmonero.co and we will resolve the issue on a case-by-case basis. We make an effort to prevent a mistaken deposit; GlobalMonero assumes no liability for deposits made on limited accounts.
If your account is **terminated**, any funds in your wallet will be lost and you will not be able to recover them. If GlobalMonero terminates your account without request, the account will first be **limited**, and the email associated with the account will be given a warning 48 hours before the account is finally terminated, and the client is expected to withdraw any XMR within that time frame. The username previously associated with the account will remain reserved after termination.
### Deposit and Withdrawal
To sell XMR on GlobalMonero, you are required to use our escrow wallets by depositing Monero cryptocurrency on our platform. If a deposit or withdrawal made is not recognized by GlobalMonero, please reach out at service@globalmonero.co with details, and we will honor any transactions. However, we are not liable for deposits that are not automatically recognized and that do not have sufficient transaction proof. Evidence is considered sufficient if you can supply the following:
- The Transaction ID ("TXID").
- The Transaction Key.
- The escrow wallet address (the Monero address receiving the XMR).
- The transaction proof.
- Proof that the transaction is recognized by the Monero blockchain.
Users buying XMR with GlobalMonero are not required to use our escrow wallets and we are not liable for user errors with personal wallets or any other software not operated or maintained by GlobalMonero.
### Trades
The primary function of GlobalMonero is to facilitate peer-to-peer XMR trades. By creating an account and meeting certain requirements, you are able to create Monero trade offers to broadcast that you wish to either send or receive Monero.
By posting a trade, you agree to meet the following requirements:
- The information in the trade offer must be accurate and up-to-date at all times.
- If the trade offer is currently active, you must be active to interact with users that accept your trade offer.
- The instructions in your trade offer must be concise and clear. Vague instructions can result in disputes resolved against you.
- The information in your trade offer must be without malicious intent against potential buyers or against GlobalMonero. If you are found to be posting trade offers maliciously, your offer will be cancelled and your account will be terminated.
### Disputes
GlobalMonero provides an escrow and arbitration service for trades made on our platform, and aims to make accurate and fair decisions for every dispute raised. With that in mind, GlobalMonero and its staff are not liable for arbitration decisions.
#### General resolution guidelines
While disputes are handled on a case-by-case basis, there are general guidelines to our resolution process.
- We generally resolve in favor of the **buyer** if the buyer can provide sufficient evidence of completing the transaction outlined in the trade offer requested by the seller or if the seller is found unresponsive.
- We generally resolve in the favor of the **seller** in any other case, including if the agreed payment was not made or only partially fulfilled; if the payment processor used froze the funds before the buyer properly received them; or if the buyer is found unresponsive.
- In rare cases, we might split the XMR between the buyer and the seller; however, this is only for extremely specific scenarios and usually requires agreement from both parties. If the buyer provides only partial funds, the trade is generally resolved completely in favor of the seller.
#### Unresponsiveness
If you are in an active dispute (regardless of whether you initiated the dispute), you are expected to be **responsive**. If you do not respond to a dispute claim within 24 hours, you are generally deemed unresponsive and the dispute will likely be resolved against you.
#### Dispute review
If you believe a dispute was resolved incorrectly, you can request a review by contacting service@globalmonero.co within 14 days of the dispute being finalized.
### Fees
GlobalMonero's only platform-imposed fee is **1%** on trade completion For a limited time, **0%** platform fee. However, all trades are also subject to the "transaction fees" required for transactions to be recognized on the Monero blockchain. These fees are extremely small and largely negligible, but they are unavoidable for transactions made on the Monero blockchain.
### Limitation of Liability
In no event shall GlobalMonero, its affiliates, or any of its operators or service providers be liable, whether in an action based on a contract indemnification, obligation, tort (including without limitation negligence), collaterally or arising from any statutory duty, pre-contract or other representations, or otherwise, however arising, for any economic losses (including, without limitation, loss of revenues, profits, contracts, business, goodwill, or anticipated savings) or any direct, indirect, special, incidental, consequential, exemplary, or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the website or the content, materials, and functions related thereto, your provision of information via the platform, lost business, or lost sales, even if such Protected Entity has been advised of the possibility of such damages.
### General
We may transfer or assign our rights and duties under this Agreement to any party at any time without notice to you, but this will not affect your rights or our obligations under this Agreement. You may not, however, transfer or assign any of your rights and duties under this Agreement to any other party. Any attempted assignment in breach of this Agreement shall be null and void.
